Peace and Justice Education Event: “Originalism” in Interpreting the United States Constitution

In New York State Rifle & Pistol Association, Inc. v. Bruen, the Supreme Court in 2022 applied a “historical tradition” approach to determine the scope of Second Amendment protection. Where the Second Amendment’s plain text covers an individual’s conduct, a law restricting that conduct must be consistent with “the Nation’s historical tradition of firearm regulation.” The current state of Second Amendment case law has been significantly impacted. Garrett Moritz will describe his experience defending two Delaware gun safety bills enacted shortly after Bruen—statutes regulating assault weapons and large-capacity magazines—against Second Amendment challenges to the regulations.
